I have created this privacy statement in order to demonstrate my firm and continuing commitment to the privacy of personal information provided by those visiting and interacting with this website. I hold the privacy of your personal information in the highest regard. The following discloses my information gathering and dissemination practices for this website.
I recognise the importance of protecting your privacy and my policy is designed to assist you in understanding how I collect, use and safeguard the personal information you provide to me and to assist you in making informed decisions when using my site.
It is important that you read this privacy notice together with any other privacy notice, fair processing notice or copyright notice I may provide on specific occasions when I am collecting or processing personal data about you so that you are fully aware of how and why I am using your data. This privacy notice supplements the other notices and is not intended to override them.
What Information Do I Collect?
When you visit this website you may provide me with two types of information: personal information you knowingly choose to disclose that is collected on an individual basis and website use information collected on an aggregate basis as you and others browse my website.
Personal Information You Choose to Provide
Registration Information
When you register for any of my products, services or newsletters you will provide me information about yourself. For example, you may need to provide the following information:
Name
Company Name
Email address
If you choose to correspond with me through email, I may retain the content of your email messages together with your email address and my responses. I provide the same protections for these electronic communications that I employ in the maintenance of information received by mail and telephone.
Web Site Use Information
Similar to other commercial websites, my website utilizes a standard technology called “cookies” (see explanation below, “What Are Cookies?”) and web server log files to collect information about how my website is used. Information gathered through cookies and web server logs may include the date and time of visits, the pages viewed, time spent at my website, and the websites visited just before and just after my website.
How Do I Use the Information That You Provide to Me?
I use personal information for purposes of providing the products and services you requested, statistical analysis, to monitor the use of the service, my marketing and promotional efforts and improve my content and service offerings, and customize my site’s content, layout, services and for other lawful purposes. These uses improve my site and better tailor it to meet your needs.
This means that personally identifiable information or business information will not be shared with other parties except as required by law.
Occasionally, I may also use the information I collect to notify you about important changes to my website, new services, and special offers I think you will find valuable. You may notify me at any time if you do not wish to receive these offers by emailing me at the link provided on the newsletter or by contacting hello@michellerichards.co.uk
Generally, I do not rely on consent as a legal basis for processing your personal data other than in relation to sending third party direct marketing communications to you via email or text message. You have the right to withdraw consent to marketing at any time by contacting us.
I will only use your personal data for the purposes for which I collected it, unless I reasonably consider that I need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.
If I need to use your personal data for an unrelated purpose, I will notify you and I will explain the legal basis which allows me to do so.
Please note that I may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.
What Are Cookies?
A cookie is a very small text document, which often includes an anonymous unique identifier. When you visit a website, that site’s computer asks your computer for permission to store this file in a part of your hard drive specifically designated for cookies. Each website can send its own cookie to your browser if your browser’s preferences allow it, but (to protect your privacy) your browser only permits a website to access the cookies it has already sent to you, not the cookies sent to you by other sites. Browsers are usually set to accept cookies. However, if you would prefer not to receive cookies, you may alter the configuration of your browser to refuse cookies. If you choose to have your browser refuse cookies, it is possible that some areas of my site will not function as effectively when viewed by the users. A cookie cannot retrieve any other data from your hard drive or pass on computer viruses.
How Do I Use Information I Collect from Cookies?
As you visit and browse my website, the site uses cookies to differentiate you from other users. In some cases, I also use cookies to prevent you from having to log in more than is necessary for security. Cookies, in conjunction with my web server’s log files, allow me to calculate the aggregate number of people visiting my website and which parts of the site are most popular. This helps me gather feedback to constantly improve my website and better serve my clients.
IP Addresses
IP addresses are used by your computer every time you are connected to the Internet. Your IP address is a number that is used by computers on the network to identify your computer. IP addresses are automatically collected by my web server as part of demographic and profile data known as traffic data so that data (such as the web pages you request) can be sent to you.
Pixels
We use technologies, such as cookies, to customise content and advertising, to provide social media features and to analyse traffic to the site. I also share information about your use of my site with Facebook.
This site uses the Facebook pixel to collect data on visitor behaviour so that I test future marketing activities or to tailor my services and products to your chosen preferences, such as:
– which pages are visited
– which device was used to view the website
– what actions were taken
This information may be used to serve Facebook ads my services for up to 180 days after each visit until you request to:
Amend your information
Opt Out
Have your data erased.
Facebook have issued confirmation that their systems and processes will be GDPR compliant: www.facebook.com/business/news/facebooks-commitment-to-data-protection-and-privacy-in-compliance-with-the-gdpr
Sharing and Selling Information
I do not share, sell, lend or lease any of the information that uniquely identify a subscriber (such as email addresses or personal details) with anyone except to the extent it is necessary to process transactions or provide services that you have requested.
How Can You Access and Correct Your Information?
You may request access to all your personally identifiable information that I collect online and maintain in my database by emailing me at hello@michellerichards.co.uk
What About Legally Compelled Disclosure of Information?
We may disclose information when legally compelled to do so, in other words, when we, in good faith, believe that the law requires it or for the protection of my legal rights. I may also disclose account information when I have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating my terms of service or to protect the safety of my users and the public.
What About Other Websites Linked to my Website?
We are not responsible for the practices employed by websites linked to or from my website or the information or content contained therein. Often links to other websites are provided solely as pointers to information on topics that may be useful to the users of my website.
Please remember that when you use a link to go from my website to another website, my privacy policy is no longer in effect. Your browsing and interaction on any other website, including websites which have a link on my website, is subject to that website’s own rules and policies. Please read those rules and policies before proceeding.
My Commitment to Data Security
Whenever I transfer your personal data out of the EEA, I ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:
– I will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission. For further details, see European Commission: Adequacy of the protection of personal data in non-EU countries.
– Where I use certain service providers, I may use specific contracts approved by the European Commission which give personal data the same protection it has in Europe. For further details, see European Commission: Model contracts for the transfer of personal data to third countries.
– Where I use providers based in the US, I may transfer data to them if they are part of the Privacy Shield which requires them to provide similar protection to personal data shared between the Europe and the US. For further details, see European Commission: EU-US Privacy Shield.
Choice/Opt-In/Opt-Out
This site allows visitors to unsubscribe so that they will not receive future messages. After unsubscribing I will discontinue sending the particular messages as soon as technically feasible.
Surveys & Contests
From time-to-time my site requests information from users via surveys or contests. Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include contact information (such as name and shipping address to notify prize winners), and demographic information (such as geographical country, and age level to determine eligibility to enter). Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site and my marketing activities.
A Special Note About Children
Children are not eligible to use my services unsupervised and I ask that children (under the age of 18) do not submit any personal information to us. If you are a minor, you can use this service only in conjunction with permission and guidance from your parents or guardians.
How Long I Retain Data
By law I have to keep basic information about my customers (including Contact, Identity, Financial and Transaction Data) for seven years after they cease being customers for tax purposes.
In some circumstances you can ask me to delete your data: see request erasure below for further information.
In some circumstances I may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case I may use this information indefinitely without further notice to you.
Your Legal Rights
You have the right to:
Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data I hold about you and to check that I am lawfully processing it.
Request correction of the personal data that I hold about you. This enables you to have any incomplete or inaccurate data I hold about you corrected, though I may need to verify the accuracy of the new data you provide to us.
Request erasure of your personal data. This enables you to ask me to delete or remove personal data where there is no good reason for me continuing to process it. You also have the right to ask me to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where I may have processed your information unlawfully or where I am required to erase your personal data to comply with local law. Note, however, that I may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
Object to processing of your personal data where I am relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where I am processing your personal data for direct marketing purposes. In some cases, I may demonstrate that I have compelling legitimate grounds to process your information which override your rights and freedoms.
Request restriction of processing of your personal data. This enables you to ask me to suspend the processing of your personal data in the following scenarios: (a) if you want me to establish the data’s accuracy; (b) where my use of the data is unlawful but you do not want me to erase it; (c) where you need me to hold the data even if I no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to my use of your data but I need to verify whether I have overriding legitimate grounds to use it.
Request the transfer of your personal data to you or to a third party. I will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for me to use or where I used the information to perform a contract with you.
Withdraw consent at any time where I am relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, I may not be able to provide certain products or services to you. I will advise you if this is the case at the time you withdraw your consent.
If you wish to exercise any of the rights set out above, please contact me.
– You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, I may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, I may refuse to comply with your request in these circumstances.
– I may need to request specific information from you to help me confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. I may also contact you to ask you for further information in relation to your request to speed up my response.
– I try to respond to all legitimate requests within one month. Occasionally it may take me longer than a month if your request is particularly complex or you have made a number of requests. In this case, I will notify you and keep you updated.
Policy Modifications
I may change this Privacy Policy from time to time. I will post any changes here, so be sure to check back periodically. However, please be assured that if the Privacy Policy changes in the future, I will not use the personal information you have submitted to me under this Privacy Policy in a manner that is materially inconsistent with this Privacy Policy, without your prior consent.
